1. Operator status
Xaldia is a browser-based MMORPG operated from Québec, Canada. The technical repository identifies the Xaldia project, but it does not establish a complete public legal identity for the person or entity acting as merchant/operator.
Before commercial production launch, the legally correct merchant name, geographic address, telephone number and, where applicable, verified electronic contact must be published in the purchase flow and contract documentation. No fictitious corporation or address is inserted into these Terms.
2. Acceptance and eligibility
By creating or using an account, entering the game, using community features or initiating a purchase, you agree to these Terms to the extent you have legal capacity to do so. If applicable law requires authorization from a parent, tutor or other legal representative, you may use the service only with that authorization.
Xaldia currently has no technical age-verification or parental-consent workflow. These Terms therefore do not claim that a user's age or parental authorization has been verified. A compliant age/consent mechanism must be implemented before the service is made available to users for whom such consent is legally required.
3. Accounts and account security
- You may create a Xaldia account with an account identifier, email and password, or use supported Google sign-in.
- You are responsible for keeping your credentials and devices reasonably secure and for not intentionally sharing authentication tokens.
- Information supplied to create or recover an account should be accurate and must not impersonate another person.
- Do not use another person's account without authorization.
- Notify Xaldia through the official support channel once that channel is published if you believe your account is compromised.
Google sign-in is an authentication option, not permission for Xaldia to access unrelated Google services. See the Privacy Policy.
4. Limited game license and intellectual property
Subject to these Terms, Xaldia grants users a limited, personal, revocable, non-exclusive right to access and use the service for its intended gameplay and community purposes.
Xaldia, its contributors and third-party licensors retain the rights they respectively hold in the game software, artwork, audio, text, branding, maps and other materials. Nothing in these Terms transfers ownership of those materials to a user. Third-party components and assets remain subject to their applicable licences.
You may not copy, sell, sublicense or exploit protected Xaldia content except where applicable law, a separate licence or express permission allows it.
5. Community conduct and fair play
To protect players and the authoritative game world, you must not:
- harass, threaten, stalk or target other people with abusive conduct;
- use hate speech, unlawful content, sexual exploitation content or content that violates another person's rights;
- impersonate Xaldia staff, another player or another person;
- spam, flood, scam, defraud or intentionally mislead players;
- use bots, scripts or automation to play the game or obtain an advantage unless Xaldia expressly authorizes that use;
- use cheats, memory manipulation, packet manipulation, modified clients or other tools to gain an unfair advantage;
- abuse bugs, duplicate items/currency, exploit race conditions or intentionally conceal a serious exploit;
- attack, bypass, probe or interfere with authentication, networking, rate limits, moderation, persistence or other security controls;
- sell or broker accounts, currency or entitlements for real money where the product does not expressly provide that feature;
- use the service for unlawful activity.
Good-faith security reports and ordinary gameplay experimentation are not treated as abuse merely because they reveal a defect. Exploiting a defect for advantage or harm is different from reporting it.
6. User-generated content
Character names, guild names and descriptions, nicknames, chat messages and similar user-created material can be transmitted or displayed through Xaldia. You remain responsible for content you submit and must have the rights needed to submit it.
You grant Xaldia only the non-exclusive licence reasonably necessary to host, transmit, display, format, moderate and remove that content for operation and promotion of the specific in-service feature in which it appears. This clause does not transfer ownership of your content to Xaldia.
Xaldia may remove or restrict content when reasonably necessary for moderation, security, legal compliance or operation of the service.
7. Moderation, suspension and sanctions
Xaldia may mute, restrict, suspend or terminate access where reasonably necessary to address cheating, abuse, fraud, security threats, unlawful conduct or serious/repeated violations of these Terms. Measures should be proportionate to the circumstances when practical.
The current product contains moderation and mute mechanisms but does not expose a verified formal appeals process. These Terms do not promise an appeal system that does not exist. Mandatory legal remedies remain available.
8. Virtual goods, Diamonds and digital entitlements
Xaldia contains game items, Premium time, Diamonds and other digital entitlements. These exist for use inside the service according to the applicable game rules and product description.
The audited web commerce flow provides no feature to redeem Diamonds for cash. Purchasing or receiving a virtual entitlement does not create a bank account, security, deposit or promise of cash value. This does not affect any mandatory refund, cancellation or consumer right created by law.
Xaldia may rebalance gameplay, item statistics, drop rates and game systems as the service evolves. A change to gameplay balance does not authorize Xaldia to disregard mandatory consumer obligations relating to a paid digital product.
9. Payments and fulfillment
Supported real-money purchases use Stripe Checkout on a Stripe-hosted payment page. The audited Shop currently offers Diamond packs in Canadian dollars and credits the corresponding Diamonds to the account only after server-side payment confirmation. Items purchased with Diamonds are processed by Xaldia's authoritative account/game systems.
Before submitting payment, you should be shown the product, quantity where applicable, price, currency, applicable taxes/fees, total and payment information needed to make an informed decision. You must have an opportunity to correct errors, refuse or accept the order before payment is submitted.
The current source code does not by itself establish a complete Québec-compliant pre-contract disclosure and written-contract delivery workflow. In particular, the verified merchant identity/address are missing and the application does not prove that a complete, printable contract containing all required information is sent to the consumer within the legally required period. Real-money production sales must remain subject to remediation of those gaps.
10. Refunds, cancellation, unauthorized transactions and disputes
Xaldia does not impose an “all sales are final” rule that overrides mandatory consumer rights. Rights provided by the Québec Consumer Protection Act or other applicable law continue to apply.
A request relating to an unauthorized transaction, duplicate/error charge, non-delivery, defective fulfillment or another legally protected situation must be assessed according to the facts and applicable law. Any voluntary refund policy adopted by Xaldia will operate in addition to, not instead of, those mandatory rights.
The commerce system receives refund and dispute events from Stripe and can update or revoke the corresponding digital entitlement when appropriate. An entitlement change after a refund or dispute will not be used to remove rights that applicable law does not allow Xaldia to exclude.
A verified customer-support contact must be published before production commerce so refund, cancellation and transaction problems have a real resolution channel.
11. Availability, maintenance and changes to the game
Xaldia is an online game in active development. Servers, features, maps, content, rules and balance can change. Maintenance, security incidents, provider outages or technical faults can interrupt availability.
Xaldia does not promise uninterrupted or error-free operation. Where a paid transaction is affected by an outage or failure, this clause does not displace any remedy that mandatory law provides.
12. Privacy
Personal information is handled as described in the Xaldia Privacy Policy. The policy explains Google sign-in, browser session storage, gameplay records, Stripe transactions, public-site analytics, WebRTC and the current privacy-compliance gaps.
13. Warranties, responsibility and mandatory rights
To the maximum extent permitted by applicable law, Xaldia is provided on an as-available basis and no additional warranty is created beyond warranties that the law makes mandatory or that Xaldia expressly provides for a specific product.
No limitation in these Terms applies where applicable law prohibits that limitation. In particular, these Terms do not waive mandatory Québec consumer protections or liability that cannot legally be excluded.
14. Governing law and disputes
These Terms are intended to be governed by the laws applicable in Québec, Canada, without depriving a consumer of mandatory protections that apply to them. Nothing in these Terms requires a Québec consumer to litigate exclusively in a foreign jurisdiction or waive a forum or remedy that mandatory law preserves.
Consumers can consult the Office de la protection du consommateur du Québec for official information about their rights.
15. Changes to these Terms and contact information
Xaldia may update these Terms as the service changes. Material changes should be communicated in a way appropriate to their importance, and the new effective date should be shown before the updated Terms govern future use where required by law. Changes will not retroactively remove rights already created by mandatory law.
The legally verified operator/merchant identity, geographic address and official support contact remain required owner inputs. Until those are published, these Terms are a truthful description of the current product and rules, but not proof that commercial production compliance is complete.
